Agreeing to these terms

These Terms of Use (the “Terms”) apply to your use of the HZN Wellness website, including every page, feature and piece of content on it (the “Site”). The Site is operated by HZN Wellness (“HZN Wellness,” “we,” “us” or “our”).

By using the Site, you agree to these Terms and to our Privacy Policy and Medical Disclaimer, which are part of these Terms. If you don't agree, please don't use the Site.

These Terms cover the Site only. If you become a patient, your care, your payments and your use of the patient portal are governed by separate agreements, consents and policies that you review and accept in the patient portal. If those documents conflict with these Terms, those documents control for the services they cover.

This website is not medical advice

Everything on the Site, including descriptions of medications, programs, eligibility, side effects and results, is general information for educational purposes. It is not medical advice, a diagnosis or a treatment recommendation, and it is not a substitute for care from a qualified health care professional who knows your history. Our Medical Disclaimer explains this in more detail.

Using the Site does not create a doctor-patient relationship with Dr. Devan Partridge, any clinician on our care team or HZN Wellness. Reading the Site, clicking a button, or sending us a message through the contact form does not make you a patient. A clinician-patient relationship begins only if a licensed clinician reviews your information through our secure patient portal and agrees to provide care.

If you think you may have a medical emergency, call 911 or go to the nearest emergency room. The Site and the contact form are not monitored for urgent medical needs.

Eligibility and treatment are decided by a clinician

Our programs are available only to adults 18 and older who are located in Utah, and who meet the medical criteria for treatment. Information on the Site about who may be a fit is general and does not mean you qualify.

Whether you are eligible, and whether any medication is prescribed, is decided by a licensed clinician using your health information in our secure patient portal, not by the Site. A clinician may ask for more information, labs or a visit before deciding, and may decline to prescribe. Medication is provided only if a clinician prescribes it, and prescriptions are filled by a licensed pharmacy.

The patient portal, payments and other outside services

The program buttons on the Site take you to our Get started page, which links to a secure patient portal, and the “Sign in” links go straight to that portal. It is run by a third-party electronic health record provider on our behalf. Your assessment, consent forms, payment, messages with your care team and medical records are handled there, not on the Site.

The patient portal, payment processors, pharmacies, shipping carriers and other outside services have their own terms of use and privacy policies, which apply when you use them. We don't control those services and are not responsible for their availability, content or practices, except as required by law or by our separate agreements with you as a patient. Please read their terms before you use them.

Prices and program details

We try to keep the prices, program descriptions and other details on the Site accurate and current. They are provided for information and may change without notice. The price, billing schedule, cancellation terms and refund policy that apply to you are the ones shown to you and accepted in the patient portal before you pay.

If we find an error on the Site, we may correct it at any time. A price or description on the Site is not an offer that binds us until it is confirmed in the patient portal.

Our content and trademarks

The Site and its content, including text, graphics, logos, photographs, page designs and the “HZN Wellness” name and logo, are owned by HZN Wellness or its licensors and are protected by copyright, trademark and other laws.

You may view and print pages from the Site for your own personal, non-commercial use. You may not copy, modify, republish, distribute, sell or create works based on the Site or its content, or use our name or logo, without our written permission.

Using the Site fairly

When you use the Site, you agree not to:

• use it for any unlawful purpose or in violation of these Terms;
• send false, misleading, harassing, threatening or unlawful messages through the contact form;
• send health information through the contact form (please use the patient portal for anything about your health);
• impersonate another person or misrepresent your connection with anyone;
• try to gain unauthorized access to the Site, its servers or any connected system, or interfere with its security or operation;
• upload or transmit viruses, malware or other harmful code;
• use automated tools such as bots, scrapers or crawlers to collect content or information from the Site, other than standard search engine indexing; or
• use the Site in any way that could damage, disable or overburden it.

We may limit, suspend or block access to the Site for anyone who violates these Terms.

Links to other websites

The Site may link to websites we don't operate, such as the patient portal, public health resources or tools like browser add-ons mentioned in our Privacy Policy. Links are provided for convenience. We don't control or endorse other websites and aren't responsible for their content, accuracy or privacy practices.

Disclaimers

The Site and its content are provided “as is” and “as available.” To the fullest extent the law allows, HZN Wellness disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement.

We don't promise that the Site will always be available, uninterrupted, secure or free of errors, or that its content is complete or current. Health information changes over time, and the Site may not reflect the most recent research or guidance. We don't guarantee any particular result from any program or treatment; individual results vary.

Limitation of liability

To the fullest extent the law allows, HZN Wellness and its owners, physicians, clinicians, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of, or inability to use, the Site or its content, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for any claim arising out of or related to the Site is limited to one hundred U.S. dollars ($100).

These limits apply to your use of the Site only. They do not limit any liability for medical care provided to you as a patient, which is governed by applicable law and your patient agreements, and they do not apply where the law does not allow them. Some states do not allow certain limits on liability, so some of these limits may not apply to you.

If you misuse the Site

To the extent the law allows, you agree to defend, indemnify and hold harmless HZN Wellness and its owners, physicians, clinicians, employees, contractors and agents from any claims, losses, damages and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site.

Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Site will be brought only in the state or federal courts located in Utah County, Utah, and you and HZN Wellness consent to the jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time. When we do, we'll post the new version on this page and change the effective date at the top. Changes apply from the date they are posted. If you keep using the Site after that, you accept the updated Terms.

General terms

These Terms, together with the Privacy Policy and Medical Disclaimer, are the entire agreement between you and HZN Wellness about the Site. If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a part of these Terms right away, we haven't given up the right to enforce it later. You may not transfer your rights under these Terms; we may transfer ours, for example as part of a merger or sale of our business.

We may change, suspend or discontinue any part of the Site at any time.
